Offensive Content


You may not publish or transmit via AmotherbyHosting.co.uk service any content that Amotherby Hosting reasonably believes:

• constitutes pornography;
  
• is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
  
• is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
  
• is defamatory or violates a person's privacy;
  
• creates a risk to a person's safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement;
  
• improperly exposes trade secrets or other confidential or proprietary information of another person;
  
• is intended to assist others in defeating technical copyright protections;
  
• clearly infringes on another person’s trade or service mark, patent, or other property right;
  
• promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
  
• is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to Amotherby Hosting; or
  
• is otherwise malicious, fraudulent, or may result in retaliation against Amotherby Hosting by offended viewers.
  
• is an 'EXE' file.

Security


You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically. You may be held responsible for damages done by your account, accessed by your password.



Bulk Commercial E-Mail


The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.



Unsolicited E-Mail


You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it.

You must comply with the rules of any other network you access or participate in using Amotherby Hosting services.

Time spent dealing with issues related to bulk mail or Unsolicited mail may be charged at £75 per hour.



Copyright Material


You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner or are otherwise permitted by applicable copyright law.



Other


You must have valid and current information on file with your domain name registrar for any domain hosted on the Amotherby Hosting network.



Disclaimer

Amotherby Hosting is under no duty, and does not by these terms undertake a duty, to monitor or police our customers' activities and disclaims any responsibility for any misuse of the Amotherby Hosting.



Internet & Service Abuse

You may not engage in illegal, abusive, or irresponsible behavior, including:

• Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network;
  
• Monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
  
• Interference with service to any user, host or network including, without limitation, deliberate attempts to overload a system and broadcast attacks;
  
• Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning, password robbery, security hole scanning, and port scanning;
  
• Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
  
• Any conduct that is likely to result in retaliation against the Amotherby Hosting’s network.
  
• Use of Amotherby Hosting’s network in a way that unreasonably interferes with other customers use of the network.
  
• Implement any such tool that allows or may allow anonymous use to a Customer Website as a web proxy. The Customer is responsible for all actions associated with the use of the Services and their account howsoever occurring.
  
• Implement any such tool that allows any IRC functionality, which includes but is not limited to IRC bouncers, bots and servers.

Serice Level Agreement


Amotherby Hosting offers a 99.9% uptime guarantee. Uptime is counted as the following services: HTTP, HTTPS, DNS, FTP, POP, IMAP, MySQL being available from the internet. If uptime falls below 99.9% in a month you are eligable for a refund of the period of downtime rounded up to the nearest hour. You must make your request and have proof that the service was down if our monitoring service say the services were up. Downtime due to DNS propergation and planned maintenance is not covered.



Disclaimer


Amotherby Hosting will not be responsible for any damages you or your business may suffer as a result of your use of the service or as a result of any malfunction or downtime. Amotherby Hosting takes no responsibility or liability for the content hosted by any one using our services. We reserve the right to suspend services to anyone who break these terms. And if illegal content is hosted it may be reported to the correct legal authority.

Regarding the interpretation of these terms, Amotherby Hosting's interpretation, in its reasonable commercial judgment, shall govern. For clarification of any clause please contact us before agreeing.

Amotherby Hosting reserve the right to update these terms at any time.

Amotherby Hosting is not responsible for your data nor any loss of your data. We do make backups but you should keep your own. If your account has unpaid invoices for over 15 days all your data may be removed from our servers at any time. Access to you account may be suspended at any time if you have overdue invoices. A reconnection charge of £25 may be applied to any suspended account.



Cancellation Policy


All Accounts are generally billed monthly/yearly in advance. In the event that the Customer elects to pay by cheque or other similar method, the Customer will be provided with an electronic invoice, available through their nominated AmotherbyHosting.co.uk user account. All payments for invoices are due within 15 days of issue, unless otherwise stated. This payment is non-refundable unless within a money back guarantee. Domains are non-refundable and no money back guarantee is offered on them. The Customer agrees to hereby notify AmotherbyHosting.co.uk in writing via support.amotherbyhosting.co.uk or billing [at] amotherbyhosting.co.uk of any disputed Charges within 30 days of the billing date for such Charges. In the event the Customer fails to dispute the invoice within the respective time period, the Customer has waived any right to dispute any amounts either directly or indirectly. All accounts which are overdue by 15 days may be charged interest from the due date of the lesser of;
(i) 5% per month on the due amount; or
(ii) the highest legal rate of interest.

Amotherby Hosting reserves the right to forward outstanding debts to a collection agency or their legal representatives for collection. The Customer is responsible for paying all costs associated with the collection, including but not limited to reasonable legal fees.



Force Majeure


Amotherby Hosting shall not be responsible or liable for any failure or delay or consequence thereof in the performance of its obligation under this Agreement owing to strikes, lockouts or other industrial disputes (whether or not involving the workforce of any party), Act of God, embargo, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, direction, regulation, accident, breakdown of plant or machinery, fire, flood or storm or to any other cause whatsoever beyond Amotherby Hosting's reasonable control or after the effects of the foregoing. If any such delay occurs then (unless the cause therefore shall frustrate or render impossible or illegal the performance of the relevant Agreement which shall otherwise discharge the same) the period for Amotherby Hosting to perform its obligations hereunder shall be extended by such period (which for the avoidance of any doubt is not limited to the lengths of delay) as Amotherby Hosting.co.uk may reasonably require to complete such performance obligations.

In the event that Amotherby Hosting shall have cause to rely on this clause, Amotherby Hosting shall upon becoming aware of an occurrence of Force Majeure furnish such notice to the Customer in addition to details of the circumstances where relevant.

In the event that a Force Majeure occurrence shall continue or may be reasonable expected to continue for a period of more than 1 calendar month, Amotherby Hosting may mutually agree with the Customer to terminate this Agreement.



Privacy Policy


Amotherby Hosting values the privacy of the information of its Customers. This Privacy Policy applies to the website www.amotherbyhosting.co.uk and relevant sub domains thereof, in addition to the services and products through this Website. From time to time, Amotherby Hosting may make changes to the website and respective products and services, accordingly Amotherby Hosting reserve the right to update this Privacy Policy in its sole discretion or as may be required.

Upon a Customer requesting Services from Amotherby Hosting, certain information will be required. This may include, but is not limited to, your name, date of birth, your business name, your address, email address, telephone number, facsimile number and mobile number. This information may be used for the management and administration of any account and to enable Amotherby Hosting to make contact with the Customer from time to time as may be required.

When any person may visit the amotherbyhosting.co.uk Website, Amotherby Hosting may store any IP Address and use Cookies where appropriate, which Amotherby Hosting may use for internal statistical analysis or as otherwise may be applicable. Amotherby Hosting may also store non-personal information, such as your browser type.

Amotherby Hosting will not divulge any personal information to any third party save for the following reasons;

• As required to do so by law, regulation, statute, treaty or similar provision and/or to any organisation, agency or otherwise with appropriate authority and/or in Amotherby Hosting’s sole discretion to safeguard its own business interests, or that of its Customers, or as otherwise detailed in any associated Agreement.
  
• In order to register a domain, Amotherby Hosting are required to send some personal details to a Registrar to record the registration. Such information may be available to others via a WHOIS search.
  
• To any financial institution with whom we hold any account for the purpose of verifying the credit status and/or validating financial transactions.
  
• As part of any sale or transfer of AmotherbyHosting.co.uk to any other third party.

The Customer agrees to hereby provide notice to Amotherby Hosting of any change to personal details or other information as required from time to time.
